Platform terms

About these terms
These Platform Terms (the "Terms") are a binding agreement between Hanse and the business that creates an account or uses the Service ("Customer", "you").
You accept these Terms by creating an account, clicking to accept, or using the Service. If you accept on behalf of a company, you confirm you have authority to bind it. The Service is for business use only and is not offered to consumers.
The Data Processing Agreement ("DPA") at gethanse.eu/dpa forms part of these Terms. If you and Hanse sign a separate order form or agreement, it prevails over these Terms where they conflict.
Definitions
- Service: the Hanse platform, including the dashboard, APIs, serverless and dedicated deployments, the Playground and related documentation.
- Customer Data: data you or your Users submit to the Service, including prompts, inputs, files and models you upload, together with the Outputs.
- Outputs: content generated by Models in response to your Customer Data.
- Models: the open-source and third-party models available through the Service, and any models you bring.
- Users: individuals you authorise to access your account.
- Credits: prepaid units used to pay for the Service.
- Usage Data: metadata about how the Service is used, such as request counts, token volumes, latency, errors and processing region, excluding the content of Customer Data.
Your account
You must be at least 18 and acting for a business. You must give accurate account and billing information and keep it up to date.
You can invite Users to your organisation and assign them roles (admin, member). You are responsible for all activity under your account, including your Users' actions and any use of your API keys. Keep credentials and API keys confidential, and tell us promptly at privacy@gethanse.eu if you suspect unauthorised access.
The Service
Hanse gives you access to Models through serverless endpoints on shared infrastructure and dedicated deployments with reserved capacity in a region you choose. Routing rules let you decide how requests are served based on cost, performance or quality profiles.
Requests are processed on infrastructure in the European Economic Area ("EEA") by default. The Service logs the region where each request is processed, so you can verify where your data was handled.
We use third-party infrastructure providers to deliver the Service. Where they process personal data, they act as our sub-processors and are listed in the DPA.
We may improve, change or remove features. If we remove a material feature you actively use, we will give you at least 30 days' notice where reasonably possible. Features marked beta, preview or experimental are provided as is, may change or end at any time, and are excluded from any service commitments.
Customer Data and Outputs
You own your Customer Data and Outputs. You grant Hanse a limited licence to process and transmit inputs and outputs only as needed to provide, secure and support the Service, and as required by law.
Hanse does not use Customer Data or Outputs to train or improve any models.
Hanse processes personal data in Customer Data as your processor under the DPA. We keep request logs for up to 15 days for operations, security and billing, unless the law requires us to keep them longer.
You are responsible for your Customer Data, including having the rights and a lawful basis to submit it, and for how you use Outputs. Outputs are generated by machine learning models, may be inaccurate, and may be similar to outputs generated for others. Review Outputs before relying on them, especially for decisions that affect people.
We may use Usage Data to operate, secure, bill for and improve the Service.
Acceptable use and model licences
You must not use the Service to:
- break any law, including sanctions, export control and data protection law
- create or distribute child sexual abuse material or any content that sexually exploits minors
- generate content that harasses, threatens, defames or unlawfully discriminates against people, or that infringes others' rights
- develop malware, carry out cyberattacks or gain unauthorised access to systems
- create deceptive content, including impersonating real people without their consent
- carry out any practice prohibited under the EU AI Act
- resell the Service as a standalone inference offering without our written consent
- overload or disrupt the Service, get around usage limits, or test its security without our written permission
- reverse engineer the Service, except where the law allows
Models are provided under their own licences, such as Apache 2.0, MIT or model-specific community licences. You must comply with the licence and any acceptable use policy of each Model you use, which we link to in the Service. If you bring your own model, you confirm you have the rights to deploy it.
You are responsible for your own obligations under the EU AI Act and other laws that apply to the AI systems you build on the Service.
Fees, credits and payment
The Service is paid for with prepaid Credits. Usage is charged against your Credit balance at the prices shown on our pricing page or in the Service when the usage happens. Dedicated deployments are charged for the time they are running, whether or not they receive requests.
You buy Credits in advance through our payment provider. Prices exclude VAT and other applicable taxes, which are added at checkout.
When your balance reaches zero, we may pause your deployments and API access until you top up. We will try to notify account admins by email when the balance is running low.
Paid Credits do not expire and are non-refundable, except where these Terms say otherwise or the law requires. Promotional or free Credits may have their own conditions and expiry.
We may change prices with at least 15 days' notice. New prices apply only to usage after the change takes effect. If you think a charge is wrong, tell us within 30 days at billing@gethanse.eu.
Availability and support
We work to keep the Service available and performant, but we do not offer a service level agreement unless one is agreed in a signed order form. We may carry out planned maintenance and will try to give advance notice of anything likely to cause significant disruption.
Support is available by email at support@gethanse.eu during 08:30 - 19:00, CET. Higher support levels can be agreed separately.
Confidentiality and intellectual property
Each party may receive confidential information from the other, including Customer Data and non-public product, pricing and technical information. The receiving party will use it only to perform under these Terms, protect it with at least reasonable care, and share it only with employees, contractors and advisers who need it and are bound by similar duties. This does not apply to information that is public, already known to the receiving party, independently developed, or lawfully received from a third party. Disclosure required by law is allowed, with prior notice where legally permitted.
Hanse owns the Service and all related intellectual property, including software, documentation and the Hanse brand. Apart from the right to use the Service under these Terms, no rights are transferred to you. If you give us feedback, we may use it without restriction or obligation.
Warranties and disclaimers
Each party confirms it has authority to enter into these Terms. Hanse will provide the Service with reasonable skill and care and in line with the DPA.
Otherwise, to the fullest extent permitted by law, the Service, Models and Outputs are provided "as is" and "as available". We do not warrant that the Service will be uninterrupted or error-free, that Outputs will be accurate, complete or fit for a particular purpose, or that third-party Models are free from third-party claims.
Limitation of liability and indemnities
Neither party is liable for indirect or consequential loss, or for loss of profits, revenue, goodwill or data, even if foreseeable.
Term, suspension and termination
These Terms apply from when you accept them until your account is closed.
General
- Changes to these Terms: we may update these Terms. For material changes, we will notify account admins by email or in the Service at least 30 days before they take effect. If you do not agree, you can close your account before then and we will refund unused paid Credits. Continued use after the effective date means you accept the update.
- Notices: to Hanse at legal@gethanse.eu; to you at the email address of your account admin.
- Assignment: neither party may assign these Terms without the other's consent, except to a successor in a merger, acquisition or sale of substantially all of its business.
- Subcontractors: Hanse may use subcontractors and remains responsible for their performance.
- Force majeure: neither party is liable for delays caused by events beyond its reasonable control. This does not excuse payment obligations.
- Publicity: Hanse may name you as a customer and show your logo unless you opt out by emailing us.
- Entire agreement: these Terms, the DPA and any signed order form are the whole agreement between the parties on this subject. If a provision is unenforceable, the rest remains in effect. A failure to enforce a right is not a waiver, and no third party has rights under these Terms.
